Halkın Hukuk Bürosundan Berkin Elvan Mahkemesine Çağrı

Müvekkilimiz Berkin Elvan 16 Haziran 2013 sabahı ekmek almaya giderken polislerin yakın mesafeden, hedef alarak attığı gaz fişeğinin kafasına isabet etmesi sonucu ağır yaralı olarak hastaneye kaldırılmıştı. Gezi Ayaklanmasının sembolü haline gelen Berkin Elvan 269 gün boyunca hastanede yoğun bakımda kaldı. Bu süreç boyunca onu vuran polislerin yargılanmasını istedik ancak hiçbir talebimiz mahkeme tarafından kabul edilmedi, yargılama yönünde hiçbir adım atılmadı.

Berkin Elvan için verilen adalet mücadelesi 11 Mart’ta 16 kiloya düşerek öldüğü zaman da devam etti. Berkin’i bütün Türkiye halkları sahiplendi ve 3 milyon insanla birlikte onu sonsuzluğa uğurladık.

Berkin Elvan vurulalı tam 4 yıl oluyor. Dosyasına dair atılan tek adım nihayet bir duruşma gününün belirlenmiş olması. Berkin’in vurulma anının video kayıtları da olmasına rağmen 3 polisten hiçbirinin ismi açıklanmadı ve sadece bir polis tutuksuz yargılanıyorlar.

6 Nisan’da Çağlayan Adliyesi’nde ilk duruşması yapılacak ve yargılanan polis ana mahkemeye çıkarılmadan, çalıştığı yer olan Van ilinden görüntü ve sesli bağlantı ile ifade verecek. Bu uygulama yargıda yüzyüzelik ilkesine de aykırıdır.

Yapılacak ilk duruşmaya tüm meslektaşlarımızı dayanışmaya çağırıyoruz.

Berkin’in katillerinin korunmasına karşı bizler de adalet için müvekkilimizi savunacağız.

On April 6 we will be at the Caglayan Palace of Justice!

On the morning of June 16, 2013 our client Berkin Elvan went to go for bread and was seriously wounded by police who shot him in the head at close range with a gas canister, after which he was removed to hopital. Berkin Elvan became a symbol of the Gezi uprising, lingering in intensive care for 269 days. During this process we wanted the police who shot him to be prosecuted, but none of our attempts to press charges were accepted by the court and no attempts were made to bring them to justice.

Berkin Elvan’s struggle for justice continued, even as he died on March 11, 2014, having wasted away to just 16 kilos.  All the peoples of Turkey accepted Berkin as their own and three million people attended his funeral.

It is four years since the shooting of Berkin Elvan. According to the file, the first date for a court hearing has finally been fixed. Despite the existence of a video showing Berkin being shot, none of the names of the three police involved have been released and just one policeman has had charges pressed against him, without being imprisoned in remand.

On April 6 the first hearing will take place at Caglayan Palace of Justice (in Istanbul) and the policeman who has been transferred to Van Province (in the east of Turkey) will make a statement by a long-distance audiovisual link. This practice is contrary to the principle of being personally present in court.

We call for solidarity from all our professional colleagues at this first hearing.

We will defend for the sake of justice our clients from those who are protecting the murderers of Berkin.
